The Mayor and Council of the Borough of Bogota will conduct and in-person public meeting on May 19, 2022.  A  Public Hearing will take place on the following Ordinances

 

The Mayor and Council of the Borough of Bogota will conduct and in-person public meeting on May 19, 2022.  A discussion will be held regarding the Bergen County Trust Fund Municipal Program for Park Development Grant Program, and the Borough of Bogota’s Funding Request Application for the Olsen Park Improvement Project.  Olsen Park is located at 162 West Main Street, Bogota, New Jersey.  The Olsen Park Improvement Project will improve the quality of life for our residents by connecting residents with the natural resources of our environment. The Borough Mayor and Council members will be available to discuss the project and answer questions. All residents are encouraged to attend and participate.

ORDINANCE NO. _1573

 

AN ORDINANCE AMENDING CHAPTER 5 OF THE BOGOTA CODE, ENTITLED “ANIMALS”

 

WHEREAS, Chapter 5 of the Bogota Code sets forth the rules and regulations for the licensing, registration and handling of dogs in the Borough of Bogota, and;

WHEREAS, Section 5-1.3 of Chapter 5 sets forth the license and registration fees for dogs in the Borough, and;

WHEREAS, the aforementioned Section currently sets forth an annual license fee of $6.80 for each dog in the Borough, and;

WHEREAS, the Bogota Board of Health has recommended that the annual license fee set forth in Section 5-1.3 be increased to $10.80, to be in keeping with the license fees charged by neighboring municipalities, and;

WHEREAS, the members of the Board of Health voted in favor of recommending this revision at its meeting of December 13, 2021, and;

WHEREAS, the Mayor and Council wish to amend Section 5-1.3 to codify the new annual dog license fee recommended by the Board of Health.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Bogota, that Chapter 5 of the Bogota Code is hereby amended, revised and supplemented as follows:

Section 1:  Amendment to Section 5-1.3, entitled “License and Registration Fees”.

 

            Section 5-1.3, entitled “License and Registration Fees” is hereby amended, revised and supplemented as the follows:

                        5-1.3. LICENSE AND REGISTRATION FEES.

Any person applying for a license and registration tag shall pay to the borough clerk the sum of ten dollars and eighty ($10.80) cents for each dog to be licensed and in addition thereto the sum of one dollar and twenty ($1.20) cents for the registration of each dog; and for each annual renewal, the fee for the license tag; and said license, registration tags and renewals thereof shall expire annually on January 31.

 

There shall be an additional charge of three ($3.00) dollars for the licensing of each dog that is nonspayed or nonneutered.

 

There shall be an additional charge of ten ($10.00) dollars for each license and registration applied for after the last day of January.

 

 Section 2:  Severability.

 

If any section, subsection, paragraph, sentence, clause or phrase of this Ordinance shall

be declared invalid for any reason whatsoever, such a decision shall not affect the remaining portions of the Ordinance, which shall remain in full force and effect, and for this purpose the provisions of this Ordinance are hereby declared to be severable.

Section 3:  Inconsistency.

 

Any and all ordinances, or parts thereof, in conflict or inconsistent with any of the

terms and provisions of this Ordinance are hereby repealed to such extent as they are so in conflict or inconsistent.

Section 4:  Adoption. 

 

This ordinance shall take effect twenty (20) days after the first publication thereof after final passage, and shall remain in force until modified, amended or rescinded thereafter by the Borough of Bogota.

CALENDAR YEAR 2022 ORDINANCE TO EXCEED

THE MUNICIPAL BUDGET COST OF LIVING ALLOWANCE

AND TO ESTABLISH A CAP BANK

 (N.J.S.A. 40A-4-45.14)

 

WHEREAS, the Local Government Cap Law, N.J.S. 40A:4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget up to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and,

 

WHEREAS, N.J.S.A. 40A:4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and,

 

WHEREAS, the Governing Body of the Borough of Bogota in the County of Bergen finds it advisable and necessary to increase its CY 2022 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and,

 

WHEREAS, the Governing Body hereby determines that a 1% increase in the budget of said year, amounting to $81,921 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and,

 

WHEREAS, the Governing Body hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years.

 

NOW, THEREFORE BE IT ORDAINED, by the Governing Body of the Borough of Bogota in the County of Bergen, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2022 budget year, the final appropriations of the Borough of Bogota shall, in accordance with this ordinance and N.J.S.A. 40A:4-45.14, be increased by up to 3.5%, amounting to $286,724, and that the CY 2022 municipal budget for the Borough of Bogota be approved and adopted in accordance with this ordinance; and,

 

BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and,

 

BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and,

 

BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption.
